These Terms and Conditions (“Terms”) govern the services provided by Peak Pioneers IT (“Company,” “we,” “our,” or “us”) to clients (“Client,” “you,” or “your”). By requesting services, scheduling work, or allowing work to be performed, you agree to these Terms.

1. Services Provided

Peak Pioneers IT provides professional on-site IT and low-voltage services, including but not limited to networking, structured cabling, troubleshooting, installation support, upgrades, testing, and related technical services. All services are performed based on the information provided by the Client and the agreed scope of work.

Any additional work requested outside the original scope may require separate authorization and may be billed accordingly.

2. Scheduling and Site Access

Clients are responsible for providing timely access to the site, systems, equipment, and any required contacts necessary to perform the work. Delays caused by lack of access, unavailable personnel, inaccurate information, or site conditions beyond our control may result in rescheduling or additional charges.

3. Pricing and Payment Terms

Pricing is based on agreed rates, estimates, or quotes provided prior to service when applicable.

Payment terms are Net 30 unless otherwise agreed in writing.

Invoices are issued upon completion of services or project milestones.

Late payments may result in suspension of future services until the account is brought current.

4. Acceptance of Services

Services are considered accepted once work has been completed and tested on-site. Any concerns regarding the services provided must be communicated within a reasonable time following completion. Failure to do so constitutes acceptance of the work performed.

5. Client Responsibilities

The Client agrees to:

Provide accurate and complete information regarding site conditions, systems, and equipment

Ensure systems are properly backed up when applicable

Maintain appropriate licenses, permissions, and compliance for all software and hardware

Obtain any required approvals or permissions for work to be performed

Peak Pioneers IT is not responsible for pre-existing issues, undocumented configurations, or limitations caused by third-party systems or equipment.

6. Third-Party Equipment and Services

Peak Pioneers IT is not responsible for failures, limitations, or issues caused by third-party equipment, cabling, software, internet service providers, utility providers, or manufacturers. Any recommendations or assistance involving third-party products are provided without warranty.

7. Warranty and Limitation of Liability

Services are performed in a professional and workmanlike manner. To the maximum extent permitted by law:

Peak Pioneers IT is not liable for indirect, incidental, or consequential damages.

Liability, if any, is limited to the amount paid for the specific service giving rise to the claim.

We are not responsible for data loss, business interruption, or system downtime beyond our control.

8. Cancellations and Rescheduling

Clients should notify Peak Pioneers IT as soon as possible if services need to be cancelled or rescheduled. Late cancellations or no-shows may result in a service charge, particularly if time or resources were reserved.

9. Confidentiality

Any non-public or proprietary information shared during the course of service will be treated as confidential and used solely for the purpose of performing the requested work, unless disclosure is required by law.

10. Independent Contractor

Peak Pioneers IT operates as an independent contractor. Nothing in these Terms creates an employment, partnership, or joint venture relationship.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

12. Changes to These Terms

Peak Pioneers IT reserves the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of the current Terms.
